Terms of Service

These Terms of Service ("Terms") govern your access to and use of the StarTrading website, application process, educational content, mentorship, community, and any related services (together, the "Service"). Please read them carefully. By accessing the Service, submitting an application, booking a call, or enrolling in the mentorship, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are

The Service is provided by StarTrading ("StarTrading", "we", "us", or "our"), operated by an individual (sole proprietor) based in Germany. You can reach us at starbeyondthesky@proton.me. References to "Star" refer to the founder and lead mentor of StarTrading.

2. What StarTrading Is (and Is Not)

StarTrading provides education and mentorship about financial trading. Our Service may include educational material and lessons, a proven price-action framework, live and recorded sessions, one-on-one and group mentorship, market commentary, and access to a private community.

StarTrading is strictly an educational and mentorship service. We do NOT: trade on your behalf, manage your money or accounts, place orders for you, hold or receive client funds, provide personalised investment advice, sell trading signals as a managed product, or operate any prop firm challenge or trading account for you. You alone make and are responsible for every trading decision and every order placed in your own accounts.

3. Not Financial Advice — No Advisory Relationship

This is the most important part of these Terms. All content, lessons, sessions, commentary, examples, and communications provided through the Service are for general educational and informational purposes only. Nothing we provide is, or should be treated as, financial advice, investment advice, a personal recommendation, an offer or solicitation to buy or sell any financial instrument, tax advice, or legal advice.

Neither StarTrading, nor Star, nor any of our partners, affiliates, employees, contractors, mentors, moderators, guest speakers, interviewees, collaborators, or any other person, brand, business, or project associated with us — whether related to StarTrading or not — is a licensed or registered financial advisor, investment advisor, broker, dealer, fund manager, or fiduciary of any kind. No advisory, fiduciary, brokerage, or agency relationship is created between you and any of the above by your use of the Service. This applies equally across all of our channels, communities, social media, interviews, and other projects.

You should not act, or refrain from acting, on the basis of anything provided through the Service. Before making any financial or trading decision, you should do your own research and consult an independent, appropriately licensed professional who is familiar with your individual circumstances.

4. Trading Risk Disclosure

Trading foreign exchange, indices, commodities, cryptocurrencies, and other leveraged or derivative instruments carries a substantial risk of loss and is not suitable for everyone. You may lose some or all of your invested capital, and with leveraged products you can lose more than your initial deposit. You should only trade with money you can afford to lose entirely.

The high degree of leverage available in some markets can work against you as well as for you. You are solely responsible for assessing whether trading is appropriate for your financial situation, experience, and risk tolerance.

5. No Guarantees — Results Are Not Typical

We do not and cannot guarantee any particular result, including any profit, income, return, funding, or the passing of any prop firm evaluation. Trading outcomes depend on many factors outside our control, including your own decisions, discipline, risk management, and market conditions.

Any performance figures, statistics, win rates, screenshots, testimonials, member results, or examples shown anywhere on the Service are illustrative only, reflect individual experiences, and are not typical or a promise of future results. Past performance is not indicative of, and does not guarantee, future results. Your results may differ substantially, including the possibility of loss.

6. Prop Firms Are Independent Third Parties

Any proprietary trading firms ("prop firms") referenced on the Service are independent third parties. We are not affiliated with, sponsored by, endorsed by, or acting on behalf of any prop firm unless expressly stated. Their evaluations, rules, fees, resets, payout terms, and account conditions are set solely by them and may change at any time. We do not control them and cannot guarantee any outcome with them. Your relationship with any prop firm is governed by that firm's own terms.

7. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that any information you provide is accurate and complete.

8. Applications and Bookings

The mentorship is application-based. Submitting an application or booking a consultation call does not guarantee acceptance and creates no obligation on either side until the mentorship is expressly agreed. We reserve the right to accept or decline any applicant at our sole discretion. A consultation call is a no-obligation conversation to assess fit and, where appropriate, provide an individual quote.

9. Fees and Payment

Pricing for the mentorship is quoted to you individually during or after your consultation call and depends on your circumstances and the scope agreed. No payment is taken through this website. Any payment terms, methods, currencies, and applicable taxes are agreed with you directly at the time of enrolment. You are responsible for any taxes, bank, or transfer fees on your side.

10. Refunds and Cancellation

If you are a consumer, you may have a statutory right to withdraw from a distance contract within 14 days. Because the mentorship consists of digital content and educational services that are made available to you immediately, you will be asked, when you enrol, to expressly request that we begin providing the Service straight away and to acknowledge that you lose your 14-day right of withdrawal once we do. Giving this consent is a condition of gaining immediate access.

The Service is considered to have begun, been supplied, and been used — and is therefore no longer refundable — as soon as any of the following happens after enrolment: (a) you access, stream, download, or watch any part of the video library, lessons, or other educational content; (b) you receive mentorship, coaching, or any personalised guidance or advice from us, in any form or shape; or (c) you are granted a role or access to our private paid community, for example our Discord server. Once any one of these has occurred, the Service has been used, and no refund will be issued, to the fullest extent permitted by law.

If none of the above has yet occurred and you withdraw within the 14-day period, you are entitled to a refund of amounts paid for the Service not yet supplied. You may stop participating at any time, but this does not entitle you to a refund of amounts due for the Service already used. Initiating a chargeback or payment dispute in breach of these Terms may result in immediate termination of access. Nothing in this section removes any mandatory rights you have under applicable consumer-protection law that cannot be waived.

11. Your Responsibilities and Acceptable Use

By using the Service you agree to:

• Use the Service only for lawful purposes and in line with these Terms.
• Provide accurate, current, and complete information when you apply or communicate with us.
• Take full responsibility for your own trading decisions, capital, and risk management.
• Keep mentorship materials, session recordings, and community content confidential and for your personal use only.
• Not copy, record, redistribute, resell, publish, or share our content, materials, or community access with any third party without our written permission.
• Behave respectfully in the community and not harass, spam, scam, or impersonate others.
• Not use the Service to give financial advice to others while presenting yourself as affiliated with StarTrading.

12. Intellectual Property

All content, materials, curricula, strategies, videos, graphics, trademarks, and other intellectual property made available through the Service are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable, non-exclusive licence to access and use them for your own learning while you are an active participant. You may not copy, distribute, sublicense, or create derivative works from them without our explicit written permission. Any content you submit remains yours, but you grant us a licence to use it as needed to operate the Service.

13. Community and Conduct

Access to any private community (for example, a Discord server) is a privilege, not a right. We may add, restrict, or remove your access at any time for conduct we consider harmful, abusive, unlawful, or in breach of these Terms or the community rules. Beware of impersonators: we will never direct-message you first asking for money, and we are not responsible for the actions of anyone impersonating us.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information provided is complete or current. This does not exclude any warranty that cannot be excluded under applicable law.

15. Limitation of Liability

To the maximum extent permitted by law, StarTrading, Star, and our partners, affiliates, and personnel shall not be liable for any trading or investment losses, or for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or your trading activity. To the extent we are found liable, our total aggregate liability shall not exceed the amount you actually paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless StarTrading, Star, and our partners, affiliates, and personnel from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your trading decisions, your breach of these Terms, or your violation of any law or the rights of a third party.

17. Third-Party Links and Services

The Service may reference or link to third-party websites, tools, brokers, prop firms, or platforms. We do not control and are not responsible for their content, policies, or practices. Any dealings you have with third parties are solely between you and them.

18. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct we believe violates these Terms or is harmful to us, other participants, or third parties. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property terms) will survive.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules. The courts of Germany shall have jurisdiction over any dispute, and where you are a consumer, the competent courts of your place of residence within the EU as provided by law. If you are a consumer, you retain the benefit of any mandatory protections of the law of the country where you live that cannot be derogated from by agreement.

20. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date below, and where required by law we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
